| STATE AND FEDERAL HIGHLIGHTS |
SENATE INTERIM ISSUE BRIEFS RELEASED
The Senate Committee on Community Affairs recently released an Interim Issue Brief on Impact Fees. House Bill 227, passed this session, creates a "preponderance of the evidence" standard of review placing the burden of proof on the local government to show that the imposition or amount of an impact fee meets the requirements of case law and s. 163.31801, F.S. The objective of the interim study was to assess the impact of the change in the burden of proof; however there have been no challenges to impact fees to date under this new standard of review. Therefore, this issue brief gives an overview of the law as it applied to impact fees prior to the change in the burden of proof. Additionally, the Senate Committee on Environmental Preservation and Conservation released two issue briefs. The Coastal Management Issue Brief (2010-314) provides a comprehensive overview of Florida's coastal management program. This program is based on a network of agencies implementing 23 statutes that protect and enhance the state's natural, cultural and economic resources. The brief focuses on issues involving the uses and management of the state's coastal submerged lands and federal consistency requirements. SMART GROWTH FOR COASTAL AND WATERFRONT COMMUNITIES
In early September, the National Oceanic and Atmospheric Administration, U.S. Environmental Protection Agency, the International City/County Management Association, and Rhode Island Sea Grant, released "Smart Growth for Coastal and Waterfront Communities." Developed in consultation with the national Smart Growth Network, the interagency guide builds on the network's ten smart growth principles to create coastal and waterfront-specific strategies for development. The guide includes an overview of the unique development challenges and opportunities along the water and provides specific approaches to development that include a description of the issues, tools and techniques, and case studies. "Smart Growth for Coastal and Waterfront Communities" is intended for planners, local government officials, developers, residents, and other stakeholders. AMERICA 2050 RELEASES HIGH SPEED RAIL REPORT
Defining the corridors in America that are most appropriate for high-speed rail service is critical to the long-term success of America's high-speed rail program. A new report by America 2050 offers one mechanism for assessing which potential high-speed rail corridors will have the greatest ridership demand based on population size, economic activity, transit connections, existing travel markets and urban spatial form and density. The authors evaluate 27,000 city pairs in the nation to create an index of city pairs with the greatest demand for high-speed rail service. The paper provides a list of the top 50 city pairs, which are primarily concentrated in the Northeast, California, and the Midwest, and provides recommendations for phasing corridor development in the nation's megaregions. PLEASE VOTE ON CHAPTER BYLAW AMENDMENTS
Amendments were developed by the bylaws committee at the direction of the Executive Committee and the membership per the Strategic Operating Plan approved in September 2008. Additional amendments were identified by the executive committee relative to new procedures and processes, e.g. the Certification Maintenance Program, as well as various clarifications and formatting corrections. All of the proposed amendments were sponsored by the Executive Committee and approved by the Executive Committee at their meeting in June 2009. The proposed amendments are posted at http://www.floridaplanning.org/exec_committee/2010/announce.asp and the ballots will arrive in the September/October issue of Florida Planning. Please carefully follow the directions for filling out the ballot AND the envelope to ensure your vote is counted! Votes are due in the Chapter Office by December 14th.

Downtown Orlando Transit Circulator Expansion Alternatives Analysis
The Central Florida Regional Transportation Authority is seeking proposals for this project. The RFP 09-R26 may be obtained from the LYNX website at www.golynx.com.
