 STATE AND FEDERAL HIGHLIGHTS
The governors of Georgia, Alabama, and Florida have agreed that their states will not sue each other for at least four months over metro Atlanta's water supply. In the meantime, they personally pledged to negotiate their states' long-standing feud over sharing the waters of two major river basins. That would move the five-year effort to reach a settlement in the TRI-STATE WATER WAR to a higher level. The Department of Environmental Protection gave notice of rule development, and five workshops, in preparation for rulemaking to establish TOTAL MAXIMUM DAILY LOADS for Lake Lafayette, Fenholloway River, Orange Creek Basin, Lake Apopka, Upper Ocklawaha Chain of Lakes area, Ocklawaha River and several tributaries to Lake Okeechobee. The Florida Department of Transportation’s Public Transit Office, recently announced that Version 2003 of the FLORIDA TRANSIT INFORMATION SYSTEM (FTIS) is available for download at: www.eng.fiu.edu/LCTR/Ftis/ftis.htm. This version includes the new 2001National Transit Database (NTD) released recently by the Federal Transit Administration. In addition, the Department has added select census 2000 data (income, employment, etc.), aerial photos for all transit service areas, and various new features, including quick peers selection and statistical functions.  REPORTS AND PUBLICATIONS
The 2002 Legislature considered but did not pass legislation to require the Office of Program Policy Analysis and Government Accountability (OPPAGA) to annually report information on the SIZE AND COST OF GOVERNMENT in Florida. However, because of continuing interest on the part of the Legislature and as authorized by s. 11.511, Florida Statutes, the Director of OPPAGA initiated this project to develop a prototype of such a report. OPPAGA’s analyses show 1) Florida has relatively low state and local taxes and total revenue compared to other states; 2) Florida's state and local taxes as a percentage of personal income increased in the early 1990s but have subsequently declined; 3) Florida has relatively high government debt compared to other states, and state government debt has risen over the last decade in response to the needs of a growing population; and 4) Florida has relatively few public employees compared to other states, and efforts to outsource public services have contributed to a recent decline in the number of state government employees. "TEA-21 REAUTHORIZATION: GETTING TRANSPORTATION RIGHT FOR METROPOLITAN AMERICA" is a new brief by the Brookings Institution, which details the importance of TEA-21 reauthorization for the nation's metro areas and offers a comprehensive policy agenda for Congress' work on the bill. The TRUST FOR PUBLIC LAND: Taking the High Road: Protecting Open Space Along America's Highways, suggests that road builders and conservationists can work together toward an improved national highway policy, one that minimizes the impacts of highway development and brings about smarter land use practices. The Florida Communities Trust announces the opening of the third Florida Forever application cycle on March 27, 2003. Approximately $66,000,000 (unless otherwise allocated by the Legislature) will be available this funding cycle for grants to local governments and nonprofit environmental organizations to acquire land for conservation, open space and outdoor recreation purposes. The deadline for submitting applications to FCT is 6:00 pm (EST), June 10, 2003. Despite widely predicted resistance from much of the building industry and some municipal leaders to California's new law (AB857), under which the state will give infrastructure funding priority to jurisdictions that promote infill development, higher residential densities and farmland protection, many planners, farmers and environmentalists place their hopes for better state growth management on strong support from Governor Gray Davis, whose director of planning and development Tal Finney says about the law, ''More than ever, the dollars have to follow the policies'' of smart growth. Such financial allocation, reports Associated Press writer Jim Wasserman in The Sacramento Bee, is most advanced in Maryland, whose Special Secretary for Smart Growth Harriet Tregoning confirms director Finney's assessment. She calls the new California bill -- written by Democratic Assemblywoman Patricia Wiggins and backed by urban planners, along with the 80-partner California Futures Network -- ''a very good idea,'' but one that ''won't work by itself,'' pointing out that Maryland uses ''a full set of incentives'' for growth in targeted areas, where infrastructure is usually older, land-related processes longer and community opposition ''more vehement.'' So far, the writer notes, California let its 58 counties and almost 500 municipalities ''decide how to accommodate roughly six million new residents a decade,'' but the new law may channel most of the $56 billion state infrastructure dollars in the next five years ''toward existing neighborhoods instead of new ones.'' -- The Sacramento Bee 1/18/2003

On January 14, 2003, the 1st District Court of Appeals, in Alachua County v. Florida Rock Industries, Inc., ruled that once property was annexed into the city, the county lost its right to enforce its developer’s agreement with the owner. (_ S2d_5 03)
