This year, the Florida Forever program was not funded  the proposed $15 million is coming from surplus cash in the Florida Forever Trust Fund and the Land Acquisition Fund.&nbsp; Funding for education is increased by about $1 billion and transportation spending is reduced by more than $1 billion.<o:p></o:p></span></p> <h1 style='margin:0in;margin-bottom:.0001pt'><i><span style='font-size: 11.5pt;font-family:"Georgia","serif";mso-fareast-font-family:"Times New Roman"; color:#333333;font-weight:normal'><br> Growth Management:<span style='display:none;mso-hide:all'>&nbsp;</span><o:p></o:p></span></i></h1> <p style='margin:0in;margin-bottom:.0001pt;line-height:11.25pt'><em><span style='font-size:9.0pt;font-family:"Arial","sans-serif"'><a href="http://cts.vresp.com/c/?APAFlorida/78b228a69e/TEST/ccfe0b6e0c"><strong><span style='font-family:"Arial","sans-serif"'>SB 842 </span></strong></a></span></em><span style='font-size:9.0pt;font-family:"Arial","sans-serif"'>(Senator Bennett, R  District 21) proposes a number of changes to various statutes and is viewed as a glitch bill to last year s Community Planning Act.&nbsp; The bill has been referred to three committees.&nbsp; In addition to making numerous citation and reference corrections, the bill also proposes the following:<br> -&nbsp; Provides that any local charter provision that was in effect as of June 1, 2011 for an initiative or referendum process related to development orders or comprehensive plan amendments&nbsp; or map amendments may be retained and implemented (this language is also included in <span style='display:none;mso-hide:all'><span id="cke_bm_162S">&nbsp;</span></span><strong><i><span style='font-family:"Arial","sans-serif"'><a href="http://cts.vresp.com/c/?APAFlorida/78b228a69e/TEST/05f8380b45">CS/SB 440 </a></span></i></strong>(Bennett) which was moved favorably by the Senate Community Affairs Committee on December 5th.)<br> -&nbsp; Deletes requirements for that county marina siting plans must be consistent with state and regional environmental planning policies and standards<br> -&nbsp; Clarifies that a local government, in the expedited review process,&nbsp; has ten calendar days after the initial public hearing to transmit the amendment to reviewing agencies<span style='display:none; mso-hide:all'>&nbsp;</span><br> -&nbsp; Deletes 163.3180.6(i) that deals with criteria for determining if a municipality has no significant impact on school attendance<br> -&nbsp; Deletes some of the time frames related to administrative challenges to comprehensive plans<br> -&nbsp; Requires that regional planning councils must make a formal public determination that acceptance of a grant will not diminish the council s capacity to fund and accomplish its statutory functions before accepting the grant<br> -&nbsp; Prohibits a regional planning council from providing consulting services for a fee to a local&nbsp; government for a project for which the council also serves in a review capacity or provide consulting services to a private&nbsp; developer or landowner for a project for which the council may&nbsp;also serve in a review capacity in the future<br> -&nbsp; Deletes the substantial deviation criteria for RV parks<br> -&nbsp; Deletes some of the language related to the scheduling, submittal and review of interlocal agreements between school boards, counties and non-exempt municipalities<span style='display:none;mso-hide:all'>&nbsp;</span>&nbsp;<br> <br> <span style='display:none;mso-hide:all'>&nbsp;</span><strong><i><span style='font-family:"Arial","sans-serif"'><a href="http://cts.vresp.com/c/?APAFlorida/78b228a69e/TEST/984ee48c93">HB 603 </a></span></i></strong>(Representative Weinstein, R-District 19) and <strong><i><span style='font-family:"Arial","sans-serif"'><a href="http://cts.vresp.com/c/?APAFlorida/78b228a69e/TEST/68832f7f92">SB 912 </a></span></i></strong>(Senator Bennett, R-District 21) both would prohibit a local government for applying transportation or school concurrency or requiring proportionate-share contribution or construction&nbsp;until July 1, 2015 unless authorized by an affirmative vote of two-thirds of the local government s governing authority.&nbsp;&nbsp; A development must receive a certificate of occupancy by July 1, 2016 to keep this exemption.&nbsp; If it fails to do so, the local government may apply concurrency and proportionate share requirements. This prohibition does not apply to proportionate share contributions or construction assessed on existing development before July 1, 2012.&nbsp; It also does not apply if it would require modification to a local government s financing that would invalidate existing contracts.&nbsp; HB 603 is now in the House Community &amp; Military Affairs Subcommittee, while SB 912 has been referred to three committees.&nbsp;<br> <br> <span style='display:none;mso-hide:all'>&nbsp;&nbsp;</span><strong><i><span style='font-family:"Arial","sans-serif"'>Developments of Regional Impact:</span></i></strong><br> Last week, identical bills were filed in both the House and Senate pertaining to the Development of Regional Impact process.&nbsp; <strong><i><span style='font-family:"Arial","sans-serif"'><a href="http://cts.vresp.com/c/?APAFlorida/78b228a69e/TEST/fb2c940618">HB 979 </a></span></i></strong>(Representative Diaz, R-District 115) and <a href="http://cts.vresp.com/c/?APAFlorida/78b228a69e/TEST/37360a9ec1"><strong><i><span style='font-family:"Arial","sans-serif"'>SB 1180 </span></i></strong></a>(Senator Bennett, R-District 21) make a number of changes relative to the DRI process, including the following:&nbsp;&nbsp;<br> <span style='display:none;mso-hide:all'>&nbsp;</span>-&nbsp; Restricts reviewing agency comments to those that are consistent with the statutes, rules, or adopted local government ordinances that are applicable to all developments in the jurisdiction where the proposed development is located<span style='display:none;mso-hide:all'>&nbsp;</span><br> -&nbsp; Limits review of a DRI to issues directly related to land use, environmental protection and public facilities, including transportation.&nbsp; Hurricane preparedness and affordable housing can only be raised if a local government has adopted an ordinance that generally applies to all other development.&nbsp;&nbsp;No other issue may be considered.&nbsp;<br> -&nbsp; The regional planning council s report has to contain recommendations that are consistent with the standards required by the applicable state permitting agencies or the water management district or that are consistent with the land development regulations adopted by the local government if a state permitting agency or water management district standard is not applicable. The regional planning agency may not recommend a standard unless the local government has adopted the same standard in its land development regulations or in an ordinance that generally applies to all other developments or unless the standard is required by state permitting<br> -&nbsp; Changes that do not increase the number of external peak hour trips and do not reduce open space and conserved areas within the project are now not a substantial deviation.<br> -&nbsp; Includes new statutory exemption language which appears to allow a local government the option to not require DRI review if a comprehensive plan amendment for the development is adopted pursuant to the state coordinated review process.&nbsp; This exemption does not apply within an ACSC, the Wekiva Study Area or within 2 miles of the Everglades Protection Area boundary.<span style='display:none;mso-hide:all'>&nbsp;</span><br> -&nbsp; Allows the rescinding of a development order in situations where all required mitigation is not completed but will be completed pursuant to a permit or authorization issued by a governmental agency as defined in 380.031.(6).<br> <span style='display:none;mso-hide:all'>&nbsp;</span><br> Neither bill has been referred to any committees yet.<span style='display:none;mso-hide:all'>&nbsp;</span><br> <br> <strong><i><span style='font-family:"Arial","sans-serif"'>Public Meetings/Public Notice:</span></i></strong><br> Several bills have been filed related to public meetings, public notice and public participation.&nbsp; <strong><i><span style='font-family:"Arial","sans-serif"'><a href="http://cts.vresp.com/c/?APAFlorida/78b228a69e/TEST/06fa225766">SB 206 </a></span></i></strong>(Senator Negron, R-District 28) and <strong><i><span style='font-family:"Arial","sans-serif"'><a href="http://cts.vresp.com/c/?APAFlorida/78b228a69e/TEST/6bfbe571cf/FileName=_h0355__.docx&amp;DocumentType=Bill&amp;BillNumber=0355&amp;Session=2012">HB 355 </a></span></i></strong>(Representative Kiar, D-District 97) both would amend Section 286.11, F.S. to require that the public be given a reasonable opportunity to be heard on an item, although this need not be at the same meeting that official action will be taken.&nbsp; Reasonable rules can be adopted to ensure the orderly conduct of a meeting and some direction for these rules is identified.&nbsp; Both bills have been referred to three committees; HB 355 is currently before the House Government Operations Subcommittee.<br> <br> <strong><i><span style='font-family:"Arial","sans-serif"'><a href="http://cts.vresp.com/c/?APAFlorida/78b228a69e/TEST/521144076c">SB 292 </a></span></i></strong>(Senator Bennett, R-District 21) would allow a local government to use its website for legally required advertisements and public notices under certain conditions and if specifically authorized by an ordinance.&nbsp;&nbsp;
