The course covers the basic laws and planning principles that have shaped the development and approval process in Florida. Participants will receive basic instruction about Florida’s planning and growth management system with emphasis on best practice at the local government level.
Topic #1 — Planning and Growth Management in Florida. The Community Planning Act mandates that each local government in Florida adopt and implement a Comprehensive Plan and that implementation be consistent with the Comprehensive Plan. How is this system structured? What are its essential components and what is required of local governments.
Topic #2 — Constitutional and Legal Foundations for Planning in Florida. Legal concepts and important case law and what they mean for planners. Topics include the US Constitution, Florida Constitution, the Community Planning Act and other Florida statutes, legislative decisions vs quasi-judicial decisions, property rights, consistency, rational nexus and proportionate share.
Topic #3 — The Community Building Process. An overview of the Comprehensive Plan, what it contains, its legal status, the process for its development, evaluation and amendment. A primer on land development codes including zoning, subdivision regulations, planned development, concurrency, development standards, etc. with emphasis on best practice.
Topic #4 — Decisionmaking. An overview of roles and responsibilities, legislative vs quasi-judicial actions, procedures, substantial competent evidence, public participation and other topics related to decision making.
